Terms of Service

1. Agreement

By accessing or using Redactyl ("the Service"), you agree to be bound by these Terms of Service. The Service is provided by HWAI Pty Ltd (ABN pending), based in Queensland, Australia. If you do not agree to these terms, do not use the Service.

2. Description of Service

Redactyl is an on-device privacy layer that redacts sensitive data from prompts before they are sent to third-party AI models. All redaction processing occurs locally on your device. Redactyl does not process, store, or transmit your original unredacted data.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

4. Account and access

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

You retain full ownership of all data you process through Redactyl. Because the Service operates on-device, your unredacted data remains under your control at all times. We have no access to, and make no claim over, your data.

7. Third-party AI services

Redactyl facilitates interaction with third-party AI services (e.g. OpenAI, Anthropic, Google). Your use of those services is governed by their respective terms. We are not responsible for the conduct, policies, or availability of any third-party service.

8. Subscription and billing

Paid plans are billed monthly in Australian Dollars (AUD). You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice. Refunds are handled on a case-by-case basis.

9. Intellectual property

The Service, including all software, design, and documentation, is owned by HWAI Pty Ltd and protected by Australian and international intellectual property laws. These terms do not grant you any rights to our trademarks, logos, or branding.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. While we design Redactyl to accurately redact sensitive data, we do not guarantee that all sensitive information will be identified and redacted in every case. You are responsible for reviewing redacted output before sharing it.

11. Limitation of liability

To the maximum extent permitted by Australian Consumer Law, HWAI Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless HWAI Pty Ltd from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately.

14. Governing law

These terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

15. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised terms.
